Bills of Interest -- 2008 Legislative Session

These are the bills of interest to MONA that have been filed to date by the Missouri General Assembly representatives and senators.

The first column indicates the bill number; HB stands for a House Bill; SB stands for a Senate Bill. The second column is the last name of the chief bill sponsor, and the final column is a brief description of the subject matter of the bill. To learn more about the status of a bill, click on the bill number; to learn more about the person sponsoring the bill, click on the legislator's name.

Some descriptions don't sound like they have anything to do with nursing. However, the subject matter could be amended to affect us. Consequently we will track all these bills.

HB 1300 Kuessner Requires insurers providing medical malpractice insurance to health care providers to establish premiums based on the average judgment in medical malpractice cases by county during the previous calendar year.
HB 1302 Whorton Requires certain school nurses to be paid on the same pay scale as teachers with equivalent work history and working hours in their district.
HB 1325 Sater Authorizes a physician assistant or an advanced practice nurse to prescribe a schedule V controlled substance under a collaborative practice agreement.
HB 1327 Sater Requires, subject to appropriations, the Department of Health and Senior Services to establish an access to healthy food pilot program.
HB 1328 Sater Prohibits the use, sale, transfer, or licensing of certain prescriptive information by certain entities for commercial purposes.
HB 1330 Sater Requires the State of Missouri to match any grant moneys received by the state for smoking cessation up to a two million dollar cap.
HB 1331 Sater Establishes the Missouri Center for Health Information and the State Consumer Health Information Advisory Council to provide health care cost-related information.
HB 1332 Sater Establishes the Pharmacy Audit Bill of Rights Act of 2008.
HB 1339 Muschany Changes the laws regarding medical malpractice by revising the definitions of "health care provider" and "health care services".
HB 1350 Hodges, Jr. Requires health insurance coverage for fertility treatments.
HB 1374 Portwood Requires certain school nurses to be paid on the same pay scale as teachers with equivalent work history and working hours in their district.
HB 1375 Portwood Specifies that under the MO HealthNet program providers can receive enhanced reimbursement for certain services.
HB 1393 Dusenberg Requires only persons younger than 21 years of age to wear protective headgear when operating or riding as a passenger on any motorcycle or motortricycle.
HB 1398 Dusenberg Adds specialists to the list of health care providers for whom the State Legal Expense Fund is available for payment of certain claims filed against a provider.
HB 1401 Dusenberg Requires health screenings for public school students in the second and eighth grades.
HB 1424 St. Onge Re-enacts the federal overtime standards in effect prior to the passage of Proposition B (2006) regarding the minimum wage increase.

HB 1489 Donnelly Establishes a drug monitoring program and modifies existing record keeping for controlled substances and pseudoephedrine products.
HB 1504 Walton Allows physicians to use expedited partner therapy by dispensing and prescribing medications for partners of persons with certain sexually transmitted diseases who are not their patients.
HB 1546 Schaaf Changes the laws regarding infection control.
HB 1558 Hughes Establishes the Missouri Universal Health Insurance Act to provide comprehensive and necessary health care services for Missouri residents.
HB 1576 Wasson Changes the laws to implement Executive Order 06-04 that renamed the Department of Insurance to the Department of Insurance, Financial Institutions, and Professional Registration.
HB 1581 Pearce Re-enacts the federal overtime standards in effect prior to the passage of Proposition B (2006) regarding the minimum wage increase.

HB 1592 Lipke Establishes a prescription drug monitoring program.
HB 1598 Sater Authorizes a state and local sales and use tax exemption for over-the-counter or nonprescription drugs.
HB 1600 Davis Specifies that a person performing midwifery services is not engaging in the practice of medicine, osteopathy, nursing, nurse-midwifery, or any other medical practice and does not have to be licensed.
HB 1601 Bringer Creates a rebuttable presumption that the person whose name appears in the controlled substance log book which pharmacies are required to keep and maintain is the person whose transaction is recorded.
HB 1609 Cooper, R. Requires the establishment of emergency triage guidelines for care and the Emergency Triage Guidelines for Care Task Force.
HB 1619 Jones, T. Establishes the Drug Monitoring Act and requires the Department of Health and Senior Services to maintain a realtime electronic logbook on all pseudoephedrine purchases in this state.
HB 1620 Jones, T. Authorizes certain advanced practice registered nurses to enter into collaborative agreements with physicians to administer and dispense controlled substances.
HB 1634 Wildberger Establishes the Registered Surgical Technologist Title Protection Act.
HB 1643 Onder Repeals the provision allowing a person holding a ministerial or tocological certification to provide services related to pregnancy.

HB 1701 Wasson Prohibits certain requirements for immunosuppressive drugs under the MO HealthNet Program without the consent of the physician and patient.
HB 1712 Sander Changes the laws regarding emergency services and requires most counties to establish and maintain 911 addressing.
HB 1731 Walsh Establishes the Safe Staffing and Quality Care Accountability Act for Veterans Homes and the Safe Staffing and Quality Care Accountability Act for Mental Health Facilities.
HB 1739 Moore Authorizes the licensure of prescribing psychologists.
HB 1790 Cooper, R. Changes the laws regarding hospital designation to include a heart attack center and a stroke center if it meets the criteria of the Department of Health and Senior Services.
HB 1815 Portwood Clarifies the fees for copying patient care medical records and establishes the maximum amount for the combination of the notary and certification fee.
HB 1816 LeVota Establishes the Health Care Whistleblower Protection Act to protect certain health care professionals from retaliatory actions by employers for reporting violations of law.
HB 1838 Low Requires health insurers to provide coverage for human papillomavirus testing as a cervical cancer screening test.
HB 1868 McClanahan Requires the eligibility criteria for certain health care benefits to be no more restrictive than those in effect on January 10, 2005.
HB 1889 Meadows Requires the Missouri state highway patrol to provide a real-time electronic log book for pharmacies to use to enter certain drug transactions.
HB 1927 Frame Authorizes the State Highway Patrol to develop and implement a real-time electronic logbook for certain Schedule V substances and requires pharmacists and pharmacy technicians to report sales.
HB 1933 Schaaf Adds medically necessary home telemonitoring services to the list of services to be provided under the MO HealthNet program.
HB 1935 May Establishes the requirements for the practice of surgical technology in this state.
HB 2033 Page Establishes a drug monitoring program and modifies existing record keeping for controlled substances and pseudoeqhedrine products.
HB 2068 Wasson Changes the laws regarding the licensure of physical therapists and physical therapy assistants.
HB 2075 Grisamore Establishes the Missouri Commission on Autism Spectrum Disorders.
HB 2076 Grisamore Renames the Division of Mental Retardation and Developmental Disabilities within the Department of Mental Health to the Division of Developmental Disabilities.
HB 2119 Roorda Specifies that any person who unlawfully distributes or delivers any controlled substance to any person which causes that person's death will be guilty of involuntary manslaughter in the first degree.
HB 2120 Roorda Expands the list of Schedule II controlled substances to include several nitrites.
HB 2130 Talboy Requires any health care provider to notify a patient when the patient's confidential medical information is improperly disclosed to a third party.
HB 2185 Low Establishes the Paid Sick Days Act which requires employers to provide sick days with pay to employees.
HB 2244 Page Renames the Intractable Pain Treatment Act to the Pain Treatment Act and removes the term "intractable pain" from its provisions.
HB 2267 LeVota Makes it a crime to fail to report the illegal conduct of a pharmacist or other health care professional which could cause death or serious physical injury and for an administrator to conceal same.
HB 2268 Portwood Modifies the requirements for use of the term "Christian Science nurse".
HB 2342 Wilson, K Requires the implementation of a program of random drug testing for members of the General Assembly and recipients of benefits from the Temporary Assistance for Needy Families Program.
HB 2355 Flook Changes the laws regarding the Missouri Health Facilities Review Committee for the Certificate of Need Program.
HB 2370 Portwood Changes the laws regarding midwives and the practice of midwifery.
HB 2398 Schaaf Changes the laws regarding health care services and establishes the Insure Missouri Plan to provide insurance coverage to low-income working adults.
HB 2398 Page Requires each licensed hospital to create a nursing advisory board to establish and implement a standardized acuity-based patient classification system for each direct-care unit.
HB 2462 McClanahan Specifies that certain information collected from health maintenance and community-based health maintenance organizations that does not contain identifiable information will be public information.
HB 2561 Page Requires licensure of Radiologist Assistants and Radiology Practitioner Assistants by the State Board of Registration for the Healing Arts.
HJR 70 Icet Proposes a constitutional amendment establishing limits on total state general revenue appropriations.
SB 724 Scott Gives advanced practice registered nurses prescriptive authority for scheduled drugs.
SB 732 Champion Establishes a drug monitoring program and modifies existing record keeping for controlled substances and pseudoephedrine products.
SB 736 Bartle Requires school districts to adopt policies for the testing of student athletes for the unlawful use of a controlled substance, including but not limited to anabolic steroids.
SB 741 Bray Allows small employers to obtain medical coverage through the Missouri Consolidated Health Care Plan.
SB 746 Days Mandates health insurance coverage for morbid obesity.
SB 773 Shoemyer Regulates insurance agents selling Medicare Advantage plans.
SB 778 Justus Provides for optional immunization for the human papilloma virus.
